These Terms of Use ("Terms") are an agreement between you and Pacemaker Career Consulting ("Pacemaker", "we", "us", or "our"). They apply when you visit our website or use the online courses, ebooks, and workshops we offer (together, the "Services"). By creating an account, making a purchase, or otherwise using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Our Privacy Policy and Refund Policy form part of these Terms.

1. About Pacemaker

Pacemaker Career Consulting provides career development content, including online courses, ebooks, and live workshops. We are based in Toronto, ON, Canada. You can reach us at Hello@pacemakerca.com or +1 647-612-0523.

2. Eligibility

You must be at least 16 years old to create an account. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or guardian, who agrees to these Terms on your behalf.

3. Your Account

  • Give accurate and complete information when you sign up, and keep it up to date.
  • Keep your password and sign-in methods secure. You are responsible for activity that happens under your account.
  • Your account is for you alone. Do not share it or let others use it.
  • Tell us right away at Hello@pacemakerca.com if you think someone has used your account without permission.

You can sign up with an email address and password or with your Google account. Sign-in is provided through our authentication provider, Clerk.

4. Purchases and Payment

  • Prices are shown in Canadian dollars (CAD). Any applicable taxes are shown at checkout before you pay.
  • Payments are processed by Stripe. We do not receive or store your full card number.
  • A purchase is complete once Stripe confirms your payment. You can see your order details and receipt in Order History on My Page.
  • Promo codes are subject to the conditions stated with them, cannot be exchanged for cash, and may be withdrawn at any time before they are applied to an order.
  • We may correct pricing errors. If an item was listed at the wrong price, we will contact you before completing the order or offer a full refund.

5. Access to Content and Your Licence

When you buy a course or ebook, we grant you a personal, non-exclusive, non-transferable licence to view it through the Services for your own non-commercial learning. This licence does not transfer ownership of any content to you.

You can access purchased content for as long as it is offered through the Services and your account is in good standing. We may update content to keep it accurate. If we stop offering a course or ebook you have bought, we will try to give you reasonable notice so you can finish it.

Ebooks are read in our online reader. Downloading, printing, or exporting is permitted only where the reader provides that option.

6. Workshops

  • The date, time, and location or online meeting link for each workshop are shown on its page. Your seat is confirmed once payment is complete.
  • Some workshops have limited seats. Seats are allocated in the order payments are confirmed.
  • We may need to reschedule or cancel a workshop, for example if an instructor becomes unavailable. If this happens, we will tell you as soon as we can and offer a refund as described in our Refund Policy.
  • Do not record, stream, or share a workshop without our written permission.

7. Refunds and Your Consumer Rights

Refunds are handled under our Refund Policy. Nothing in these Terms limits any rights you have under consumer protection laws that apply to you, including the Ontario Consumer Protection Act, 2002.

8. Acceptable Use

When using the Services, you agree not to:

  • copy, download, record, screen-capture, resell, or redistribute courses, ebooks, or workshop materials;
  • share your account or purchased content with anyone else;
  • post anything unlawful, harassing, defamatory, misleading, or that infringes someone else's rights;
  • try to get around access controls, payment, or other security features;
  • use bots, scrapers, or other automated means to access the Services; or
  • interfere with or disrupt the Services or other users.

9. Reviews and Other Content You Post

You may post reviews and other content on the Services. You keep ownership of what you post. By posting it, you give us a worldwide, royalty-free, non-exclusive licence to host, display, and reproduce it in connection with the Services, including in our promotional materials. This licence ends when you delete the content or your account, except where it has already been shared.

Your reviews must reflect your genuine experience. We may remove content that breaks these Terms or that we reasonably consider inappropriate.

10. Intellectual Property

The Services and all content on them, including videos, ebooks, workshop materials, text, graphics, and logos, belong to Pacemaker or its instructors and licensors and are protected by copyright and other laws. Except for the licence in section 5, these Terms do not give you any rights to that content.

11. Third-Party Services

The Services rely on third-party providers, such as Stripe for payments, Google and Clerk for sign-in, and Wistia for video playback. Your use of those features may also be subject to the provider's own terms. We are not responsible for third-party websites that we link to.

12. Educational Content Disclaimer

Our content is for general educational purposes. It is not legal, immigration, financial, or professional advice for your specific situation. Career outcomes depend on many factors outside our control, so we do not guarantee any job offer, interview, salary, or immigration result.

13. Limitation of Liability

To the fullest extent permitted by law:

  • the Services are provided "as is" and "as available", and we do not promise that they will always be uninterrupted or error-free;
  • we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or opportunities; and
  • our total liability to you for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim arose.

These limits do not apply where the law does not allow them to be limited, including liability that cannot be excluded under consumer protection law.

14. Suspension and Termination

You can stop using the Services at any time and ask us to close your account by emailing Hello@pacemakerca.com.

We may suspend or close your account if you seriously or repeatedly break these Terms, if required by law, or to protect the Services or other users. Where reasonable, we will tell you first and give you a chance to respond. If we close your account without cause, we will refund any purchased content you can no longer access, in proportion to the access you lose.

15. Changes to These Terms

We may update these Terms from time to time. We will post the new version on this page and update the effective date. If a change materially affects your rights, we will give you reasonable advance notice by email or on the Services. If you keep using the Services after the change takes effect, you accept the updated Terms. The Terms in effect at the time of a purchase continue to apply to that purchase.

16. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to any consumer protection law that gives you the right to bring a claim where you live, disputes will be heard by the courts of Ontario.
